Welcome back, Deadline: Legal Newsletter readers. This Supreme Court week really started over the weekend. That’s when The New York Times published a bombshell report on the court’s internal deliberations from a 2016 case that sparked the modern “shadow docket.” There are multiple takeaways from the previously secret correspondence that led a 5-4 court to block then-President Barack Obama’s Clean Power Plan. But one of them is that, a decade later, it’s hard to ignore the court’s serial interventions backing Donald Trump’s policies.

Yet the president remains displeased with his rare loss in the tariffs case and his likely impending loss in the birthright citizenship case. In a Truth Social post on Wednesday, he called the tariffs ruling from February “an unnecessary and expensive slap in the face to the U.S.A., and a giant victory for its opponents.” He went on to write that if the justices “rule against our Country on Birthright Citizenship, which they probably will, it will be even worse, if that’s possible.”

Trump is probably right that he’ll lose the birthright citizenship case.

But he was wrong when he wrote in that same post that the court’s three Democratic-appointed justices “stick together like glue.” Indeed, a couple of days prior, Justice Ketanji Brown Jackson issued her latest solo dissent, in a Fourth Amendment case, while Justice Sonia Sotomayor only noted her disagreement with the majority without explaining it or joining Jackson, and Justice Elena Kagan didn’t dissent at all from the ruling siding with law enforcement.

The Fourth Amendment is also on the menu this coming week, with the justices slated to hear arguments Monday in Chatrie v. United States. That case involves the constitutionality of “geofence warrants,” which let the authorities get data from cellphone service providers to see who was in the vicinity of a certain place at a certain time. Okello Chatrie was convicted of armed robbery based on evidence from such a warrant. He argues that law enforcement illegally invaded his property interest and privacy expectations. The government counters that he chose to give Google his location data and that he lacks a constitutional interest in protecting it.

The term’s final hearing day is Wednesday, featuring arguments over the Trump administration’s quest to end humanitarian immigration protections for Haitians and Syrians, in a case that could affect immigrants from many countries.

The court is also set to issue opinions Wednesday, which it will continue to do sporadically as the term marches toward its unofficial end in late June. That’s when the justices typically hand down their final rulings before breaking for the summer. For now, Wednesday is the next chance to find out if the president is correct that he will likely lose the birthright citizenship case. But because that case was just argued earlier this month, coupled with its great importance, we might be waiting until closer to the end of the term to learn the answer in that one.

Season 2 of “Beef” follows the lives of two couples who work at a country club for the ultrawealthy and, because of their financial insecurity, are driven to extreme measures by their desperation. The club itself is a microcosm of our wider political and economic systems; the couples’ misery is the direct consequence of the grotesque inequality that immerses them, yet they also rely on the country club for their survival.

The hit Netflix show, which has sat on the platform’s Top 10 list since its release on April 16, is a meditation on late capitalism — the age of rampant consumerism and widening inequality that accompanied the globalization of the latter half of the 20th century —as the series explores the perversion and exploitation inherent to the system and its sustaining ideology. But what this season does most skillfully is tease out the pernicious lie that allows for late capitalism to remain unchecked: the lie that the system is natural. 

It is both deeply uncomfortable and compelling to watch our worst and ugliest instincts on screen.

The second season of “Beef,” while not as good as the first, is still an enjoyable watch. Much like the last season, it has the feel of a car crash you can’t quite look away from. It is both deeply uncomfortable and compelling to watch our worst and ugliest instincts on screen. Like many others, I imagine, I simultaneously convince myself I could never be capable of such horrific behavior yet still find myself identifying with the characters. 

That is the genius of the show. It shows us what we are capable of, as well as the internal polarization that horror produces. We want to look away, and yet we can’t. We tell ourselves we are not these people, and yet we see ourselves in them. 

Social Darwinists subscribe to the idea that systems such as capitalism reflect the natural world and support processes like natural selection. This conflation of a (profoundly unjust) human-made system with nature makes that system seem inevitable, as opposed to constructed and therefore contestable. 

The second season of “Beef” exposes this lie.

Several characters deliver their own soliloquies on capitalism, with notably disparate interpretations informed by their place in the pecking order. The poorest of them see the ills of capitalism clearly and make note of its exploitation, while the richest herald it as an extension of nature.

There is a moment in Episode 1 when Ashley (Cailee Spaeny), an unskilled worker who never finished high school and lacks health insurance, discovers she has an ovarian cyst and needs surgery to avoid it threatening her life and severely compromising her ability to have children. Distressed, she turns to her fiancé, Austin (Charles Melton), for support. In a comical and kitschy moment, Austin — a pretty jock and perhaps the dumbest character on the show, who seems to have about three brain cells and the legs of a Greek god — offers a polemic on the conditions that have led to this crisis.

“Late-stage capitalism — it’s all about fighting it, right? … The system is designed to make you feel despair. Like, the disparity is systemic, you know what I mean? … None of this is your fault, OK? The people in charge have made it impossible for us.” Austin continues, “Sometimes I can get down about it, but then I remember that we work at a f–––ing country club, where everyone grabbed the bag before we could; of course we feel this way.” He concludes by calling for global wealth distribution. 

Thus, Austin lays out the show’s thesis for us.

But set this against the law-breaking, billionaire antagonist Chairwoman Park (Youn Yuh-jung), who owns the country club and seems to have everyone under her thumb, including law enforcement. In a speech in the final episode, she has a very different take: 

My second husband always said, ‘Love is putting other person over yourself.’ But as soon as you are born, you cry for mommy’s milk. You do not care about her. You only care about yourself. Maybe you put others over self a few times, but only when it is easy. The universe is not designed for this. Thank god we survived billions of years from tiny cell to bacteria to monkey because we only care about self. That is why capitalism works. It is a system of nature. System of the self. Love lives in this system. All relationships exist in this system. They’re all the same, another way to serve the self.

What Park fails to see is that the natural world has a homeostasis to it. Wild imbalances of the sort analogous to obscene wealth inequality are naturally corrected. What’s more, she inverts the causal relationship: It’s not that capitalism honors the natural instinct to preserve the self above all else; it is, in fact, a system that demands it. 

In Episode 6, country club general manager Josh (Oscar Isaac) delivers his own meditation on capitalism to Austin in an emotionally vulnerable state after a psychedelic drug experience (which left many viewers wondering what the hell “bufo” is). He warns Austin that you may be so busy trying to survive that one day you’ll wake up only to realize just how spiritually and emotionally impoverished you are. There is no space or time for your own humanity, for meaningful connection with yourself and others. 

When the two couples become embroiled in Chairwoman Park’s twisty, shadowy and violent world, they are caught by her henchmen and separated in pairs, and find themselves in a classic prisoner’s dilemma. Josh ultimately disrupts it by sacrificing himself to save his partner, Lindsay (Carey Mulligan), and by extension the other young couple, too. His actions refute Park’s cynical take on what is “natural” — that the self comes before anything or anyone else.

At first glance, this could be interpreted as an endorsement of Park’s take: Ant colonies, like late capitalism, are deeply hierarchical; the system’s complexity makes it a brilliant metaphor. But unlike people following the demands of capitalism — placing the self above all else — ants are keen to sacrifice themselves for the sake of the collective. (Sick young ants, for instance, “will send out an altruistic ‘kill me’ signal for the worker ants who tend to them” so as not to spread disease to the colony, according to an NPR report.)

Despite Park’s claims, the hyperindividualism and gross inequality of late capitalism is in fact antithetical to our survival. We are entering a climate disaster at full throttle, a consequence of our economic system and the vast inequality late capitalism engenders. It has created an environment that nurtures many more horrors, like the rise of fascism and multiple genocides. 

Just as it does in real life, the main characters’ obsession with either acquiring wealth (to meet basic needs) or maintaining wealth leads everyone to act in ethically compromising, sometimes perverse ways. There is nothing natural about late capitalism, the show suggests. And it takes us away from the most natural instinct of all: love.

After the Justice Department announced Thursday that its Office of the Inspector General intends to audit the department’s response to the Epstein Files Transparency Act, one small detail tended to go unremarked: President Donald Trump recently put forward his own nominee to lead the office conducting that audit.

William Blier, a DOJ employee of roughly 40 years, is currently the acting inspector general in charge of the office. Blier, the longtime deputy inspector general, has served in that office for almost 20 years and, prior to that, was a career federal prosecutor in Washington, D.C., for two decades. 

But just days ago, Trump nominated a former acting inspector general, Don Berthiaume, to fill the role permanently. Whether the audit can be completed before Berthiaume can be confirmed — and how he will continue that work when and if he becomes inspector general — is unknown.

The Office of the Inspector General has said the audit’s “preliminary objective” is to “evaluate DOJ’s processes for identifying, redacting, and releasing records” and to assess how the department responded to “post-release publication concerns.”

That has been greeted with a range of reactions, from cautious optimism among survivors and their lawyers to calls for a more probing review from people experienced with inspector general audits.

If no internal oversight at all is the Trump administration’s best-case scenario, an audit is the next best thing, says Michael Bromwich, who served as the Justice Department’s inspector general from 1994 to 1999. 

“The Epstein files fiasco is one of the most highly publicized scandals in the recent history of DOJ,” Bromwich said. “Over the past 30 years, allegations of this magnitude have been dealt with by the OIG almost exclusively through special investigations conducted by the Oversight and Review Division, which is staffed by lawyers, investigators and other personnel experienced in conducting complex investigations.”

But the Office of the Inspector General conducts both audits and investigations, Bromwich said, and the difference between them is significant. “An audit is an insufficient response to the Epstein mess, and with no disrespect to the OIG’s auditors, this is not an assignment suited to the Audit Division’s training or experience.”

Bromwich suggested that any responsible examination of the department’s handling of the Epstein files must include interviews of former Attorney General Pam Bondi, current acting Attorney General Todd Blanche and FBI Director Kash Patel. But those kinds of interviews “are not within the Audit Division’s wheelhouse,” he clarified.

Lawyers for many of the survivors continued to call for accountability, tempering their welcome of the audit with skepticism.

Brittany Henderson, who with her partner Brad Edwards represents more than 100 Epstein survivors, told MS NOW, “It should not have taken this long to begin holding the U.S. Department of Justice accountable, but this audit will bring a long-awaited sense of temporary relief to many victims of Epstein.”

“We can only hope this audit is conducted in a meaningful way — one that leads to real accountability and ultimately reparations for the victims who were revictimized and harmed by these failures,” she added.

Arick Fudali, who represents roughly 10 Epstein survivors, was more critical, telling MS NOW that he hopes “this is not just another partisan performance for this administration to pretend they care about Epstein’s survivors,” but that he is eager to see “what the audit recovers from this clear attempt at thwarting transparency and accountability.”

Jennifer Freeman, who represents sisters Maria and Annie Farmer, also noted the DOJ and FBI’s prior failures. “The first batch of Epstein files [released] under the Epstein Files Transparency Act confirmed that the FBI dismissed and otherwise failed to meaningfully address Maria Farmer’s 1996 report of Epstein’s crimes, including possession and distribution of child pornography.” So while Freeman hopes the inspector general will learn why the department over-redacted some documents while publishing others, including nude photographs, she also wants the audit to ensure that “all documents relating to this horrific failure by the FBI and DOJ have been produced.”

Danielle Bensky, who first met Jeffrey Epstein when she was 17 and has alleged he groomed and abused her at his New York townhouse, was buoyed by news of the audit, calling it “amazing news! A little spark of hope.”

That hope might also be stoked by the fact that all audits culminate in public reports and can occasionally lead to internal, or even criminal, investigations. But whether the audit ever reaches those stages, much less comes to satisfying conclusions, is an open question.

Indeed, Bensky herself has been especially critical of the Justice Department in recent months. Last month she said, “I wish I could understand how this continues to happen, even after there has been so much attention around improper redactions after each disclosure.”

Amid widespread concerns about the struggling economy, a deadly and destabilizing war that hasn’t gone according to the White House’s plans and a burgeoning global energy crisis, recent polling has found two-thirds of Americans are convinced their unpopular president simply has the wrong priorities. Donald Trump could take steps to change their minds, but he apparently doesn’t want to.

On the contrary, the Republican appears far more interested in assorted renovation projects than his actual governing responsibilities. The New York Times reported:

Next up on President Trump’s renovation tour of Washington, D.C.: the Lincoln Memorial reflecting pool, which he called ‘filthy’ and ‘dirty’ and in need of a major upgrade.

Mr. Trump said on Thursday that the project was already underway to renovate the reflecting pool, which is more than 2,000 feet long and has been the site of many historic events, including Martin Luther King Jr.’s ‘I Have a Dream’ speech.

At a White House event ostensibly about health care, Trump strayed from the topic to talk about the reflecting pool between the Washington and Lincoln memorials, taking time to argue that he “actually had more people” when he spoke at a July 4 event at the reflecting pool than MLK did when he delivered his “I Have a Dream” speech in 1963. (“I have pictures of Martin Luther King’s crowd and my crowd,” the president said.)

Why make such a claim? Because Trump is who he appears to be.

The president went on to describe a situation in which he, relying on his experience as a developer who has built many swimming pools, rejected a contractor’s claim that removing the pool’s granite and replacing it with stone would take three years and cost $300 million.

“I said, ‘No, there’s a better way of doing it,’” Trump said, reflecting on a conversation that may or not have happened in reality. “I said, ‘What we’re going to do is, I’m going to call all three of these people that have worked for me in the past doing swimming pools.’”

He added that he told the contractors to “give me a good price,” and one agreed to do the job quickly for “less than $2 million.”

It’s difficult to know how much of the story is true, but according to the president, work is already underway as part of an apparent no-bid contract that he worked out, with specifications he chose, with an unnamed company he claimed to be familiar with. He didn’t explain where the money came from, whether proper federal contracting procedures had been followed or whether any element of the endeavor has been or will be subject to any kind of oversight.

An Associated Press report added, “Trump brought up the project unprompted and spoke about it for several minutes.”

This latest renovation project is not to be confused with the president’s preoccupation with his ballroom vanity project, his crusade to build a “Triumphal Arch,” his apparent excitement about the construction of a temporary White House arena for an upcoming UFC fight, his desire to turn the White House Executive Office Building into a giant white blob, his stated interest in renovating the White House Treaty Room, his specific marble and paint preferences for the Kennedy Center or the dozen or so other renovation projects Trump has prioritized in and around the White House complex.

Two-thirds of Americans believe their unpopular president simply has the wrong priorities. He keeps proving them right.
